License Agreement

Notice: All documents, drawings, plans, specifications, studies, sketches, preliminary drawings, models, photos and renderings in any medium or format (Documents) originally hosted on the usefuldrawings.com domain are the property of Mark Lee, Architect and are protected by U.S. Federal Copyright Laws. These Documents are assembled and are available for purchase and download as Document Packages. The purchaser of this Document Package is responsible for reading and complying with the following prior to utilizing the Documents in any way:

Grant of License: In consideration of payment for any Document Package, Mark Lee, Architect grants you, the “Licensee”, a nonexclusive right to use the Documents to construct ONE house or structure as depicted in the Documents. Purchaser acknowledges that all rights of ownership, title, and interest in the copyrights, Documents and derivatives remain with Mark Lee, Architect. Modified Documents are considered derivatives of the original and receive the same copyright protection even if completely redrawn.

License for use of the Documents ends with the completion of the house or structure (occupancy). Documents are not transferable or assignable to a third party. Additional licenses for re-use of the Documents, building multiple structures from the plans or modified derivatives may be obtained by contacting Mark Lee, Architect at melee@usefuldrawings.com . Mark Lee, Architect reserves all rights not expressly granted to Licensee.

Copies: Document Packages are available in PDF format. Your license agreement allows you to print additional sets solely for the purpose of constructing ONE house or structure as depicted in the Documents. Any other duplication, publication, sale or distribution of any part of the Documents is unauthorized, and legally subject to the prescribed penalties set forth by U.S. Federal Copyright Laws. Mark Lee, Architect retains ownership of the Documents and all subsequent copies of any portion regardless of the format or medium of the original and other copies.

Local Conditions: These documents have been drawn to meet generally accepted requirements for house construction. However, Mark Lee, Architect cannot ensure that they will be appropriate or acceptable for your specific local site conditions or that they will meet all requirements of your state/county/local authority having jurisdiction. Compliance is solely the responsibility of the Licensee. Mark Lee, Architect advises the Licensee to have the Documents reviewed for local suitability by a local professional architect, engineer and builder prior to submission of permit application or construction.

Liability: Any use of the Documents, or modifications of the Documents, by Licensee, designers, builders, or others is done at their own risk. Documents are provided “As-Is” without representations or warranties of any kind, either express or implied, including warranties of title, non-infringement, or implied warranties of merchantability or fitness for a particular purpose. Without limitation of the foregoing, Licensee agrees that it is their responsibility to ensure, prior to use of any plans, that such plans are accurate, suitable for their purposes and compliant with all applicable laws.

Neither Mark Lee, Architect, nor anyone else who has been involved in the creation, production, or delivery of these Documents assumes liability for any direct, indirect, consequential, or incidental damages related to any house, portion of a house, or other structure which may be built from these Documents.

Purchase: All sales are final. Due to ease of electronic medium duplication, no returns are accepted and no refunds will be granted. Licensee & Builder Responsibility: Prior to starting construction, Licensee should inform the builder of the following responsibilities:

It is the responsibility of the builder to verify conformance with all governing code requirements for the geographic area in which the house or structure is to be built.

It is the responsibility of the builder to check all dimensions and details for overall accuracy appropriate to the local conditions, and to make the final selection of materials such as masonry, floor joists, lumber, structural members, construction panels, roofing, etc., all of which can create variations in dimensions and details from those contained in the Documents. Builder to reconcile all dimensional variations due to substitutions, revisions and modifications.

It is the responsibility of the builder to review all structural, mechanical and electrical requirements before construction begins. It is the responsibility of the builder that all work is in accordance with the latest edition of all applicable National, State, and Local Building Codes. It is the builder’s responsibility that all work is in accordance with the latest edition of all applicable construction standards, fire department standards, utility company standards and best practices.

It is the responsibility of the builder that all manufactured articles, material, and equipment are new and of good quality, and are also stored, applied, installed, connected, erected, used, cleaned, adjusted, operated and conditioned as directed by the respective manufacturers. Builder shall follow all instructions to sustain and preserve all expressed or implied warranties and guarantees.

Document Limitations & Disclaimers: These Documents indicate general design intent and illustrate limited, basic construction detailing. These Documents should be considered as “prototypical”, “pre-designed” or “stock” plans, due to the many factors that will ultimately shape the design of the built house or structure beyond the concept illustrated by the original designer. These factors include influential considerations such as the proposed region’s geographic conditions, specific site setting, and substitutions, modifications and/or additions to the Documents made by the Licensee, subsequent designer, builder, or others. These considerations directly affect the design parameters and necessitate a local professional to review the Documents to note how the proposed Documents should be modified in response to the local requirements. Local environmental factors such as frost depth, soil bearing capacity, seismic, wind and flood zones, exposure, etc. may vary. Local code requirements for life-safety considerations such as stair width, stair rise and run, egress windows, fire sprinklering and smoke detectors, etc. may vary. Locally available materials such as concrete, lumber species, etc. strength of materials may vary.

These Documents have been prepared to meet generally accepted professional standards and practices, and represent a great value when compared to custom design documents, but due to considerations and limitations inherent in “stock” plans and factors enumerated above, require the Licensee or their representative (local architect, engineer, designer, builder or other) to supplement these documents as required to meet all applicable federal, state, county, and/or local codes, ordinances/bylaws and regulations, etc., and are appropriate to specific local site conditions. Compliance with such requirements shall take precedence over these Documents.

Any use of these Documents without adaptation to changes in codes, standards, site conditions and other factors is at the Licensee’s sole risk. Mark Lee, Architect assumes no responsibility for changes made to these Documents by others and makes no warranties, either expressed or implied, in the use of these Documents. The Licensee agrees to defend and indemnify Mark Lee, Architect for all claims, costs, losses or damages resulting from the use of these Documents.

As these Documents are considered “stock” plans, Mark Lee, Architect has not been engaged for construction supervision or observation of any kind and assumes no responsibility to ensure that construction conforms to these plans, nor has any responsibility for construction means, methods, techniques, sequences, procedures or safety precautions in connection with the work. These Documents are NOT Signed, Stamped, nor Sealed by any professional architect or engineer. If sealed documents are required, it is the responsibility of the Licensee to seek out a local professional to modify and revise the Documents to meet requirements mandated by the local authority.

As “stock” plans, these Documents do not include detailed electrical, plumbing, heating or air conditioning drawings due to the wide variety of local codes and climatic conditions. Licensee should have a local electrical engineer, mechanical engineer or builder provide detailed electrical, plumbing, heating or air conditioning drawings as may be required for permits and construction. The foundation plan and any associated details provided in the Documents are a basic guide for a typical spread footing/poured concrete foundation system or pier foundation system, depending on that particular Document Package. The foundation design as shown may not be acceptable for all locations and is intended to show components of the foundation systems and their relationship to each other and the remainder of the building structure, and are not intended to be relied upon in absence of local site knowledge. Licensee should have a local licensed professional review these Documents and provide a site-specific foundation design if found necessary.

Names of materials and manufacturers shown on these Documents do not represent an endorsement or recommendation by Mark Lee, Architect. Final selections of any and all materials are the responsibility of the Licensee and/or representative, including, but not limited to suitable material selection, proper installation of materials, structural stability, nailing, gluing, caulking, insulating, flashing, roofing, weatherproofing, etc. and many other small items and details inherent in construction but not typically indicated in the Documents, and over which Mark Lee, Architect has no control or responsibility. These Documents provide ideas and concepts and are not intended to be complete in all respects and details. For instance, variations in standard sizes of windows and doors among different brands and types, and use of different materials and thicknesses can change details and clearances. Varying local codes, ordinances, regulations, foundation requirements, and the layout of electrical, mechanical, and plumbing systems can also change details, dimensions, and layout.

Mark Lee, Architect shall not be held liable for any errors, omissions, or deficiencies in any form by any party whatsoever.

Indemnity: Licensee (You) agree to indemnify and defend Mark Lee, Architect and anyone else who has been involved in the creation, production, or delivery of these Documents and assigns of the foregoing (collectively, the "Indemnified Parties") and hold them harmless from and against any and all losses, demands, causes of action, damages, liability and costs and expenses, including reasonable attorneys' fees, incurred or sustained by any of the Indemnified Parties in connection with (i) the use, construction, conversion, modification, misinterpretation, misuse, or reuse by you or others of the Documents or any other drawings, data or other materials furnished by Mark Lee, Architect, melee design, or usefuldrawings.com; (ii) any negligence or other acts or omissions by you or any of your employees, consultants, advisors, agents, representatives or contractors; and (iii) any breach by you of any of the provisions of this License Agreement. Mark Lee, Architect reserves the right, at his own expense, to assume, the exclusive defense and control of any matter subject to indemnification by you.
